snagadot: Terms of Sale & Rent-to-Own Agreement

These Terms are an agreement between you ("you", "Buyer") and the owner, doing business as snagadot ("snagadot", "we", "us"), [ADDRESS]. They cover buying domain names from us on snagadot.com and on any domain's for-sale page that we operate.
By making an offer, buying, or starting a Rent-to-Own plan, you agree to these Terms. If you don't agree, please don't buy.
1. Definitions
- Domain: the internet domain name you're buying from us (e.g.
wisumer.com). - List Price: the price shown to pay in full.
- Plan Price: the total fixed price of a Rent-to-Own plan, shown before checkout. It is the List Price plus the plan markup for the term you choose (§4.2).
- Rent-to-Own Plan (shown on the site as "Own it monthly"): an agreement to rent the Domain monthly, with every payment counting toward buying it (§4).
- Registrant: the person or company listed with the registry as the domain's holder.
- Transfer: moving the Domain's registration to you (§6).
2. What we sell
2.1 We sell domain names we own. Every listed Domain shows a price.
2.2 No buyer fees. We charge no buyer, escrow or service fees. Sales tax may apply where required by law (§10).
2.3 Sold as-is. A Domain is sold as a name only. It comes with no website, content, traffic guarantee, search ranking, email, or other assets, unless we say so in writing.
2.4 No trademark warranty. We don't promise that a Domain is free of third-party trademark claims, or that it suits your intended use. Checking that is your responsibility before you buy.
3. Offers
3.1 You may make an offer as a one-time amount or a monthly amount. Our system may accept, counter, or decline automatically, and our team may reply personally.
3.2 An accepted offer is held for 72 hours. If you don't complete checkout within 72 hours, the acceptance expires and the Domain may be sold to someone else.
3.3 Counters and automatic replies are invitations to buy, not binding until you complete checkout.
3.4 A Domain may sell to another buyer while your offer is pending.
4. Rent-to-Own Plans ("Own it monthly")
4.1 How it works. A Rent-to-Own Plan is a rental of the Domain with an option to own it. Each monthly payment is rent for using the Domain that month, and every payment counts toward the Plan Price. When the Plan Price is paid in full, the Domain transfers to you (§6).
4.2 Plan Price (fixed). The Plan Price is the List Price plus a markup based on the term you choose:

The Plan Price, the down payment, each monthly payment, the number of payments and the payment dates are shown to you at checkout before you agree.
4.3 0% interest. The price never grows. We charge no interest and no finance charges. Your Plan Price is fixed when you start. Nothing is added for a missed or late month, a pause, or an extension.
4.4 Down payment. At checkout you pay a down payment of 10% of the Plan Price, or one month's payment if that is larger. The rest is split into equal monthly payments.
4.5 Automatic payments. You authorise us (through our payment processor, Stripe) to charge your chosen payment method on each scheduled date until the Plan Price is paid. We'll email you a reminder 3 days before each charge. You can update your payment method anytime in your dashboard.
4.6 Using the Domain during the plan.
- Right after your down payment, you get control of the Domain's DNS through your snagadot dashboard. You can point it at your website and email.
- We remain the Registrant until the Plan Price is paid in full. You may not transfer, sell, sublease, pledge or otherwise dispose of the Domain during the plan.
- We pay the registry renewal fees during the plan.
4.7 Acceptable use. While on a plan, you won't use the Domain for anything illegal; for spam or unsolicited bulk email; for phishing, malware or fraud; for content that infringes others' rights (including trademarks); or for anything that puts the Domain at risk with the registry or registrar. We may suspend DNS service for the Domain if it's used this way, and serious or repeated misuse is a default (§4.10).
4.8 Paying early. You can pay the remaining balance anytime, with no penalty. The Transfer then starts (§6).
4.9 Missed payments.
- (a) Reminders. If a payment fails, we'll retry and remind you (email and, if you've agreed, text).
- (b) The basic rule. If a missed payment is not paid by your next scheduled payment date, the plan is in default (§4.10), unless we have agreed otherwise in writing under (c).
- (c) Hard times? Talk with us and see how we can help. Any change to your plan (for example a later due date) is at our sole discretion, is decided case by case, and applies only once we confirm it in writing. Nothing is added to your Plan Price for a missed payment.
4.10 Default. A plan is in default if:
- (a) a missed payment isn't made within the time allowed in §4.9;
- (b) you seriously or repeatedly break §4.7; or
- (c) you start a chargeback or payment dispute for a plan payment without first contacting us to resolve it. [LAWYER: confirm this is enforceable.]
4.11 What happens on default.
- The plan ends. Your DNS control ends, and the Domain returns to us for our own use or sale.
- Payments already made are not refunded. They were rent for the months you had use of the Domain.
- A defaulted plan isn't reinstated unless we agree in writing.
4.12 [OPTIONAL: owner to decide] Business use. By starting a Rent-to-Own Plan you confirm you're acquiring the Domain primarily for business purposes, not personal, family or household use.
5. Swap
While your plan is in good standing, you may swap to a different snagadot domain. What you've paid so far becomes a credit toward the new domain's price, and a new plan is set up for the difference. [Owner to confirm: swap is allowed on plans in good standing only; one swap per plan?]
6. Transfer & delivery
6.1 When. We start the Transfer promptly after you pay in full (Buy Now, an accepted offer, or the final plan payment).
6.2 How. You choose one:
- (a) Push to your account at the same registrar (Namecheap or GoDaddy), using your account username;
- (b) Auth code: we unlock the Domain and send you the transfer code to use at your registrar;
- (c) Keep it with snagadot: we stay Registrant on your behalf, renew it, and you keep DNS control, for [$X]/year. [Owner to set the fee.]
6.3 Transfer guarantee. If a Buy Now or offer purchase can't be transferred to you within 7 days of payment for reasons within our control, you may cancel and get a full refund.
6.4 Your part. You must give accurate account details and accept the transfer at your registrar. Delays caused by you or your registrar don't count toward the 7 days.
6.5 Registry rules (e.g. a 60-day transfer lock after certain changes) may delay a registrar-to-registrar transfer. A push (6.2a) or keep-with-us (6.2c) usually avoids that.
7. Refunds
- Buy Now and accepted offers: refundable only under the transfer guarantee (§6.3), or if we cancel the sale.
- Rent-to-Own payments: not refundable (§4.11), except where we cancel the plan for a reason that isn't your fault.
8. Chargebacks
If you think a charge is wrong, please contact us first. We fix mistakes fast. We keep records of your agreement to these Terms (version, date, time, IP address and browser), the payment schedule shown to you, the reminders sent, and the Domain's DNS usage, and we may share them with our payment processor in a dispute.
9. Your account & communications
9.1 Sign-in uses a one-time link sent to your email. Keep access to that email secure.
9.2 You agree to receive emails about your purchases, plans and transfers. Texts are optional; you can opt out anytime (reply STOP).
9.3 Electronic signature. Ticking the agreement box and clicking Pay counts as your signature. These Terms and your schedule are provided electronically, and you can download them from your dashboard.
10. Taxes
Prices exclude sales or similar taxes. Where required, we calculate and add them at checkout.
11. Disputes over the Domain itself
If someone files a trademark or UDRP claim over a Domain you have bought or are renting, you are responsible for responding and for the outcome, as the Domain's user. We'll cooperate reasonably.
12. Limitation of liability
To the extent the law allows: our total liability for any claim about a Domain is limited to what you paid us for that Domain, and we're not liable for indirect or consequential losses (lost profits, lost data, business interruption). Nothing here limits liability that can't legally be limited.
13. Indemnity
You'll defend and indemnify us against claims arising from your use of the Domain (including content, email, and trademark claims) during a plan or after transfer.
14. Changes to these Terms
We may update these Terms. Your purchase or plan stays on the version you agreed to. New versions apply only to new purchases and plans.
15. Governing law & disputes
These Terms are governed by the laws of [STATE], USA. Disputes go to the courts of [COUNTY, STATE] [or: binding arbitration, plus a small-claims option. LAWYER to decide].

Cancellations & refunds
All sales are final. Domain names are delivered and usable right away, so there is no cooling-off period or automatic right to a refund. At checkout you confirm this and, where the law gives you a right to cancel (for example in the EU or UK), you agree that delivery starts immediately and that you lose that right.
Bought by mistake? You can ask for a refund within 3 days of purchase from your account (My domains → Manage plan, or the link under a paid domain), telling us what happened. We review every request individually and may approve it at our discretion, typically when the domain hasn't been used (not pointed to a website or email, and not transferred). Approved refunds go back to the original card.
Cancelling a rent-to-own plan. You can cancel anytime from your account. When you cancel:
- No further payments are taken.
- Payments already made are not refunded: they paid for your use of the domain while the plan was active. The one exception: we refund the unused days of the current month's payment, prorated by day.
- The down payment (payment 1) is not refunded on cancellation.
- The domain returns to snagadot immediately and may be offered for sale again.
Missed payments. If a payment fails, update your card or contact us. Hard times? Talk with us and see how we can help. Any arrangement is at our sole discretion and applies only once we confirm it in writing. If a plan stays unpaid after the next payment date and no arrangement is made, the plan ends on the same terms as a cancellation, without the prorated refund.
Before disputing a charge, please contact us. We answer every message, usually within a day.
